Judgments & Post-Judgment Collection

Review the actual order and collection activity rather than assuming a demand letter tells the whole story.

Start with the actual court record

A collection letter is not the same as a judgment. A judgment is a court's determination in a case and can give a creditor additional collection tools. If someone says a judgment exists, identify the court, case number, parties and order rather than relying only on the demand letter.

Understand what needs separate review

The judgment amount, payments credited, interest, collection activity and any claimed lien are distinct issues. Depending on the facts, the discussion may include whether there is a basis to challenge an order, negotiate payment, evaluate an exemption or consider bankruptcy. None of those options is automatically available merely because the judgment is old or you did not participate in the lawsuit.

Florida law has specific recording requirements for judgment liens. Do not assume that every judgment attaches to every asset, or that an apparent exemption requires no action. Property ownership, the nature of the debt and the records matter.

A discharge is not the same as clearing every lien

Bankruptcy may discharge personal liability for certain debts, but a valid lien can survive. A judgment, a collection demand and a recorded lien should not be treated as interchangeable. Any property or title question requires an individual review; this page does not determine whether a particular asset is protected.

Prepare for your consultation

Gather the judgment, summons, proof-of-service information, payment records, collection notices and any garnishment paperwork. Mention upcoming hearings and any prior bankruptcy. Ask what further records are needed to assess your options and document any eventual resolution.
